Terms of Service
These terms govern your use of Signally, a service of Avitech Solutions Ltd ("we"). By creating an account you agree to them and to the Acceptable Use Policy.
Accounts
You must give accurate information about your business. We review new accounts and may decline any application. You are responsible for activity under your account, API keys and SMTP credentials.
Credits and payment
Credits are prepaid. One credit sends one email to one recipient. Prices are shown in Kenyan Shillings and include applicable taxes unless stated. Credits do not expire while your account is open. Unused credits are not refundable except where required by law.
Your data
You own your contact lists and content. We process them only to provide the service, as your data processor under the Kenya Data Protection Act, 2019. Your account data is stored on our servers in Nairobi, Kenya. Email is delivered using Amazon Web Services (Amazon SES) infrastructure. Delivery and engagement events are kept for about 13 months.
Service
We aim for high availability but do not guarantee that every email will be delivered or reach the inbox: that depends on recipients' mail providers and your content and list quality.
Suspension and termination
We may pause sending to protect the platform, for example for policy breaches or unusual bounce or complaint rates. You may close your account at any time.
Liability
To the extent allowed by law, our total liability is limited to the amount you paid us in the 3 months before the claim.
